Following my meeting with Robin Deane that he promised would not be recorded I recieved a demand from Hastings council for my benefits to be reviewed, as my circumstances had not changed I did not know what to put on the forms so I called the council tax helpline and he was equally surprised at the review and did`nt seem to know what I should write either but, with his help I managed to complete the forms and attach all the documentation that they demanded (even though they already have it) Benefit awards, Tax credits, medical notes, bank statements, etc etc. I sealed this in a secure package intending to send it by registered post but I forgot to ask Lisa to take it to the post office so I asked someone to deliver it for me. All he had to do was take it into Hastings council benefit office at Aquila House and walk away but they would not let him, they made him wait while they opened it, they then told him that because it had been filled in with a blue biro he would have to copy it all out again on another form, the first problem was that he was not supposed to see my details and they did not think it was necessary to ask him for identification even though he had already explained that he was not me, he was just delivering a letter, but they did`nt care about that, the second problem was that they did not have the same form so they made him copy it all out onto another that required different answers, they then gave him my medical records, my bank statements and, all my other confidential papers, they did not put them in an envelope they just gave them to him loose, if all/any of that was not bad enough because he would not sign the new document they told him that they would photocopy my signature off of the original form.

Apart from the fact that all of the above must be very illegal they still refuse to explain who demanded the review in the first place, was it Hastings council or were they following the orders of Amicus Horizon who would very much like to see me fall into arrears with my rent.

I recieved a reply from Hastings council today. They do not mention any wrongdoing by any of their officers but they do say that I have failed to supply the documents that they returned as "unneeded" and that if I do not supply them within seven days they will stop my housing benefit which of course will result in my incurring rent arrears and give Amicus Horizon the excuse they need to issue another eviction notice.

I have checked my copy of the original form sent to me by Hastings borough council, it is dated the 19th October and states that it must be returned within 30 days from that date. The latest letter which accuses me of not returning the form also confirms that it was issued on the 19th October but says that I ran out of time on the 11th November. My maths is not good enough for me to get a job with the elite at Hastings councils bendifits offices but by my calculations I had until the 18th October to submit the form.

No wonder it feels like harassment.

I contacted Hastings council today as they continue to ignore my complaints and more importantly my replies to their sudden interest in removing my housing benefit. In a recorded call they accepted that I was not  "out of time" in returning their form (which they stated they no longer use) they asked me to return all the documents that they previously returned as "unneeded" and they offered no advice on the breach of trust and data sharing. The documents have now been sent back up to them for their consideration.

Hastings council are playing their usual game of lawbending. I recieved a letter today asking if I wanted copies of my data held by them? What data I would like etc etc. I first requested copies of all data including cctv on the 11th November 2010.
I have replied again requesting the same information again and I have also  sent off my application for a Judicial review into the way Hastings council conducted their fake review.
I have had no contact from Amber Rudd MP regarding these matters so I assume that she also has had no replies from Hastings council.
With no protection from the law we have no other choices

Letter to Hastings council

Dear Mr Wolfe,

I was surprised to recieve a letter from you today asking if I would like copies of the information held on the councils system about me and, what type of information I required.

I have now requested copies of "all" data on nine occasions and so far all requests have been refused.

I telephoned you twice today and left a message on your voicemail.

I delivered a formal request for "all" information to Aquila house today along with a cheque payment and proof of identification but once again it was refused. First visit was to the benefit department who said that they could not accept because only you "in person" was authorised to examine proof of identification. We were then directed to the planning department who gave the same bizarre excuse and refused my application, then we were redirected to the parking department who repeated the excuse for refusal, a return to the benefit section gave birth to a new excuse which was that you are the only person in Hastings who can accept an application for data release and, you are the only person in Hastings who can verify proof of identity.

I have no intention of allowing this misconduct to run me out of time, especially as I still have no confirmation that my complaints have been progressed to a higher level or even that the council has accepted my appeal against their unjust decision.

Once again I ask you directly please supply me with copies of all data held on your system about me including cctv, past court actions by the council, adaptation applications,letters,decisions from november 2005 to the present day. I require all information on all subjects, from all departments regardless of the subject. I will attempt to redeliver proof of identification and accompanying documents again tomorrow the 08th November and every day after until my application is accepted.

Look at the homes of the Amicus Horizon tenants on this site. Look,listen to the audio recordings and the video`s. Check out some of the links especially on Youtube, you will notice that all effected tenants are either disabled or have at least one family member who is. You will see how Amicus Horizon deliberately antagonise and bully them in the hope that they either give in or lose their temper and get themselves into trouble with the law. You will also see that most of these disabled tenants are under the care of Hastings council who are not only happy to stand by and watch but they actually actively participate by dishing out the same sort of treatment.
We (tenants) are left in no doubt at all that Amicus Horizon Housing Association and Hastings council often act as one in these cases and that in all of the cases that we have had dealings with Amicus Horizon have control and Hastings council just do as they are told. Manipulating benefit applications or in our case forging them or inciting others to do so is not so unusual. We have no access to the police who will not intervene no matter how serious it gets for the victims.
Many disabled people become suicidal when they are faced with no adaptations, no repairs, benefit delays or cease contact policies and many die every year "unnoticed" If I behaved in such a way that someone committed suicide I would be in very serious trouble but Councils, Housing Associations have no such problems last year 22 suicides were identified by experts who said publicly that they should have been classed as murder.
Amicus Horizon Housing Association should be placed under supervision and carefully investigated and Hastings council should join with us and help stamp out discrimination and bullying from housing and council staff.

Hastings council refuse to explain

Why
They required a benefit application when my circumstances had not changed.

They ordered someone else to complete a housing benefit application form in my name?.

They suddenly decided that the discounted part of my benefit would no longer be discounted.

Am I suddenly in £1`000`s of pounds of rent arrears? (convenient)

This form came to carry my signature?.
Why
They keep refusing my request for copies of data held about me on their files?.

They refuse to confirm that I have complained or if they even intend to allow access to their own complaints procedure?
In an earlier complaint the Housing Ombudsmans decision was that both Hastings council and Amicus Horizon had denied us access to any complaints procedure, he said he was completely satisfied that we had done everything possible.
There are many questions that Hastings council and Amicus Horizon must be made to answer. All of the above amounts to misconduct and nothing stops their behaviour, if you did it it would be classed as criminal and you would go to jail and they do it all in your name!

Dear Louise,

I realise that you would not have recieved any replies from anyone yet but I thought as Amber is the MP this might be of interest to her.

I now have 3 results from hastings council for their faked benefit review;


1 Rent benefit award £106.37. Council tax award £27.18

2.Rent benefit award £72.57 Council tax award £15.88

3 Rent benefit award £ £78.71 Council tax award 19.30

There are also different amounts awarded for 7 different periods over the previous year even though there have been no changes to income they vary from £58.72 to £104.81 on the rent and from £10.14 to £18.99 on the council tax.

I have also recieved a letter from Amicus Horizon stating that the council have informed them that my rent benefit award is
£0.00 and that I am in arrears with my rent.

I know that you genuinely try to help people but I have to ask this; Are you willing to just watch this happen? because it really does make hastings look so vindictive and so dishonest.

The I.C.O have accepted my complaint into the data loss by Hastings council and they are also looking into their reluctance to supply me with information

Finally Hastings council accepted my request for copies of data held on their system but it did take a signed blank cheque to get this far.
We are no further in regards to our appeal; Hastings council refuse to comment on whether or not this is going to be "allowed" by the benefit cheats in charge.
Our complaints have also met a brick wall (obviously not constructed by Booker and Best as it seems quite robust) and the response to all enquiries is no comment.

Thank you for your letter dated the 29th, November 2010. Received the 10th, December 2010.

I have still had no response from your offices in regard to my requests for your earlier decisions to go to appeal.
I would like to appeal the benefit awards you have applied to housing benefit for the following dates as I have good reason to believe the amounts are wrong;

Housing Benefit for the periods
  1. 06.04.2009 to 17.05.2009
  2. 18.05.2009. to 01.11.2009
  3. 02.11.2009 to 04.04.2010
  4. 05.04.2010 to 05.09.2010
  5. 06.09.2010 to 03.04.2011
  6. 04.04.2011 to 28.08.2011

I would also like to appeal each of the decisions as set out below in regard to council tax benefit awards.

Amber Rudd M.P has asked the Housing Ombudsman to look into how these reviews were conducted and I am in the process of applying for a Judicial review, I have also lodged a complaint with the I.C.O in regard to your lack of care with my personal information.

I do not accept that the fake review carried out by your staff was necessary or that it was conducted in a fair or honest manner, I believe that the motives for the review were corrupt and I do not accept your claim that I am in debt to your offices for any amount and I do not agree to you collecting any amount of repayment towards these fake debts prior to a court decision being made. Also, if any such debt does exist then it exists purely because of the incompetence of your staff. I have never had a change of circumstances that I have not notified your office of immediately and I strongly resent the implications of your false accusations that I have.

I do not accept that any person but myself has the right to complete a benefit application form on my behalf without my consent.
I do not accept that your office has the right to transfer my signature from a benefit form that I have completed onto a benefit form that I have not.

I also strongly object to you blackmailing signed blank cheques from me in order to allow me access to processes that should be open to every resident in this town.

Also your own letter received today and also in regard to all of the other letters/emails delivered to your offices. Putting a fake date on a letterhead and posting it two weeks later is not acceptable and I have no intention of allowing your offices to run my complaints/appeals "out of time" as they so often do with other people.

I have asked my M.P to ask the authorities to consider criminal charges in these and other matters and we will be demonstrating at 10 Downing Street in regard to the same later this month.

I telephoned Mrs Saxby at Hastings council today and asked for confirmation that my numerous requests to lodge appeals against their had been accepted and were being progressed but as usual no reply from Mrs Saxby. Kerry Wolfe many phone calls to him but no replies also, Amber Rudd MP my requests for support in bringing maladministration charges against Hastings council "No reply" Letters to the council "No replies".
It is policy "Set in Stone" that under no circumstances will the authorities investigate Amicus Horizon or Hastings council even though everybody knows they are breaking the law daily. If you would like to join us in our Downing Street Protest drop me a line and I will send you details

1.        Complaint
Your complaint is being treated as a stage 2 complaint which means that it is being reviewed by the Head of Financial Services, Peter Grace. His response will be e-mailed to you in the next few days. Due to the postal delays currently being experienced locally, where possible, we will make contact by e-mail.
2.        Appeal
In your letter dated 25 November 2010, you requested that you would like to appeal against the decision regarding your review. Again, in your letter of 10 December 2010, you confirm that you wish to appeal against all the decisions regarding housing and council tax benefit as you have good reason to believe that the amounts are wrong.
Your correspondence has been passed to my Appeals Officer who will contact you by e-mail should he require further information.
3.        Documents, Audio & CCTV footage
Your request for copies of all data including audio and CCTV imagery has been passed to the Council's Information Officer, Mr Wolfe, who is currently dealing with it.

I have noted your comments regarding the review and would refer you back to my letter of 19 November 2010 which covers this issue.

Dear Mrs Saxby,
Thank you for the email copy of your letter dated the15th December 2010.
1. Thank you for confirming that my complaint(s) have been progressed to stage 2 but I am concerned that although your other departments are demanding further information the person who is in control of my complaint(s) has requested no details/evidence at all.
2. I have recieved an email from the officer who is looking at my appeal(s) I will reply to him shortly.
3. Mr Wolfe has ignored all my calls and emails and I would be grateful to know the amount that he intends to fill in on my blank cheque?.
4. The letter you refer to here covers only a few of the issues raised and I would appreciate it if you would respond to the many questions that I asked and I would be very grateful if you would be specific when explaining how my signature was forged by whom? and are you doing anything about it.
5. There is nothing wrong with the mail here and as we are less than two miles away from your office and use the same sorting office I see no point at all in contacting Royal Mail.
I now have four different review decisions from your office, some recieved before the forms/documents were even delivered to you. I have been accused of being "out of time" twice when I clearly was not and this is beginning to look alarmingly as if Amicus Horizon ordered your office to behave in the way that it has. Could you possibly find a plausible reply as to why it is I have four review decisions all awarding different amounts of benefit over the periods you falsely claim my case was not reviewed and yet no matter which decision you look at the amount owed is the same and that applies to rent and also to council tax. I suggest to you that this review was nothing more than a hastily concocted scheme to bully us into closing down our website following Robin Deanes recent failure to do the same to describe it as "maladministration" is kind but I trust now that my complaints have been elevated to your office I can be sure that the forgers and liars who committed the offences detailed in my earlier letters will face certain dismissal and prosecution?

Ducking and diving of a dishonest Hastings council
Robin Deane Amicus Horizon told us that he is an ex Hastings council official today but I think we already guessed that much

We attended a meeting at Tim and Brenda`s house today with Robin Deane of Amicus Horizon who was there in response to Tims complaints. Hopefully their dispute can soon be brought to a fair and satisfactory end and they can return to a peaceful existence. Below is a copy of the letter we have sent to Mr Deane today with a couple of what we think are resonable suggestions that might help future complaints but it is very difficult to resolve any disputes when you are dealing with a company who only accepts solutions that benefit them. Fairness should go both ways, lets hope it does for Tim and Brenda.

Dear Robin,

Thank you for going to see Tim and Brenda today.

It would be good if in Tim and Brenda`s case if you could just arrange for them to be offered fair compensation because it would end their dispute rather than have it drag on endlessly which could only cause them more stress and worry and clearly in regard to the matter of the leaking water tank Booker and Best were at fault because they should have made the area safe restricted the water supply and drained the tank rather than just leave it leaking through the ceiling for 4 days.

Also may I put a couple of suggestions to you and ask if you feel they have merit that you will pass them on to the appropriate department.

1. It would be very useful to tenants if you were willing to start a housing manager league and publish it on your website; number of complaints, resolved/unresolved etc. This ight also encourage your housing managers to give better service and highlight the excellence of some and the failings of others so this could be a good guide to you as a landlord and also to us, currently the only ones who get attention are the bad ones while the good ones get little credit for their efforts. We found Kate who visited us recently to be very friendly and nice to deal with so they do exist.

2. When there are problems especially with disabled people who suffer much more from stress and worries than non disabled tenants it might help if you could consider starting an apology scheme. A small bunch of flowers or a basket of fruit can add a feeling of genuine sincerity to an apology and such small gestures often prevent serious disputes from taking root and can also create a much better relationship with your customers. I am not suggesting this as a solution in Tim and Brenda`s case because obviously things have already deteriorated beyond that point but it would be much less expensive than a year long dispute.

Anyway I hope you and your family have a nice Christmas and new year and that you can find a way to put things right for Tim and Brenda who clearly just want to be able to enjoy their home in peace.
