The Human Rights Commission are still considering my complaints as soon as I get all the results that I am waiting for I will send my files to the police and ask them to prosecute not that they will be keen to act against them.I have not heard from Michael Foster yet because he says he is still awaiting replies from Amicus Horizon.I find it ridiculous in this day and age that anyone who is in so much pain and has such limited mobility is not allowed the use of a proper toilet and bathroom. I have enough drugs to kill an elephant but not enough human rights to have my stairs fixed. At least hastings council seem reluctant to take the blame for any of this but if they don`t do something soon I will make certain they all have questions to answer.
1066ha.22nd/02/2010We received the council inspection report today which basically states that under the housing health and safety act 2004 Amicus Horizon must carry out repairs to every room in our house. It also rejects Booker and Bests inspection and orders the repair of the spread roof and the leaky walls and many other repairs. Thank you Hastings council it took nearly five years to get to this but thats because Amicus Horizon are happy to break the law. Booker and Best inspected this property less than three months ago and said that there was no sign of spread roof damage or and signs of water/damp. Amicus Horizon have been refusing to do these repairs for almost five years knowing that to do so was/is a criminal offence. I hope that a similar report is returned on our pathways and steps which should allow us access to our gardens. The above are not the only criminal offences Amicus Horizon have been happy to commit there are many more and we will pursue them all. Amicus Horizon need to be prosecuted and placed under close supervision.

I also got a report today from an expert witness involved in our case, can't wait for the day when i can publish it on the web,i think that the police will have to have a copy as i think fraud may have been commited,and then the audit commission will need a copy so they can put them into close supervision. Michael Foster so far has only promised to investigate so what he has done or not done so far I have no way of knowing but the EHRC seem to be having a good look at it but 95% of these things you have to do yourselves its always been that way. On the funnier side Sam made a video called amicustenant which he stuck up on you tube he`s completely nuts! he wrote the lyrics himself so I`m not sure if I should be proud or despair. There is a limit to how much pain anyone can take and the last week has been a real nightmare for me and my family, civil action can only do so much and it is a very slow progress so I have today made criminal complaints against Amicus Horizon and some of their employees in the hope that the police will investigate and prosecute so as I can have some kind of normality to a permanently painful existence

So that was a waste of time but I am not about to get into any dispute with our local police team over Amicus Horizon even though the last time I looked Disability discrimination was a criminal offence and so was disconnecting a domestic gas supply and so is harrassment. I will apply for the right to start a private prosecution against Amicus Horizon next week.

For the serious minded people who visit these message boards I would like to post a sincere request for your support because these are very serious issues and retaliation is real and unpleasant from our local social housing landlord.
I am insisting that the police investigate and prosecute my landlord but they are of course extremely reluctant because our landlord virtually governs this area.
1. they disconnected our gas supply for 30 days for no other reason than I had no credit on my prepayment card when they called to inspect the boiler.
2.They disconnected my water supply for 10 days because they said they forgot that a follow up repair was required.
3. They threatened me with eviction because they said I had rent arrears of over £700 they later said without an apology that they had assigned my payments to another property.
4. They issued a notice of eviction against me which they later explained had been issued by Booker and Best who were acting in retaliation against my complaints because my gas and heating were off for 30 days this winter. My landlord said that Booker and Best local builder has the right to issue eviction notices on their behalf.
5. My council has offered to put adaptations in my house that will give me access to a bathroom and the upstairs rooms and gardens but they can only do so at the request of my landlord who have stated that they do not wawnt the house adapted because their are to many adapted properties in our street.
6. The council has issued a notice of hazards that they say my landlord must remedy they ha us clear the rooms and loft of furniture two weeks ago and nothing has been done.
I realise that to some of you who work very hard and pay taxes you must resent it a little when someone who cannot work needs a stairlift or a special bath but I used to work hard and pay lots of taxes as well and like you if I broke the law I would have gone to jail. All of the above are criminal offences but the power of Amicus Horizon is such that if I call the police the police won`t come. My local council will not consider action against Amicus Horizon and they are virtually in complete control when they make recommendations the people who are paid with your taxes just seem to say yes sir. You can have a laugh or you can just pass me off as another scrounger or you can help just by emailing Michael Foster mp or the hastings observer or the hastings police. I hope it never happens but one day this could be any one of you or your family. I don`t think that Lord Falconer is the real problem or even part of the cause of any of our problems. I know it sounds like I`m a lord groveller but I`m not really, I just don`t think he has anything to do with this level of Amicus Horizon. He is just a high profile figurehead and probably would`nt even know how to help even if he was inclined to.
The courts don`t worry me very much I do not believe that they like bullying and I do not believe that they would make unfair decisions no matter how big the company. I think as far as the courts are concerned bad guys are bad guys end of story and I really believe that you can have faith in that so long as your case is before a senior judge if it was a magistrates jurisdiction I would give up before I even started.
I agree that the police are a worry but I would`nt worry very much about their magazines carrying adverts for Amicus Horizon thats probably just space fillers but the relationship between the housing managers and the local police is I think a serious problem because they need their support and automatically accept their word over any tenant but at the end of the day they are police officers and I think that if you can show a crime has been committed they will prosecute if the CPS let them. Look at the papers over the past few years... MP`s sent to jail... assistant commissioners... Doctors... I think that Amicus Horizon over estimate their power and hopefully that will be their undoing. Things change and when we get someone in charge who realises that the relationship between the police and the tenant is more beneficial than their relationship with some career junky of a housing manager then you will see happier estates and safer streets.

I have now registered my complaints against Amicus Horizon and several individuals with the police I am not going to post any progress of any of these matters on the internet because I know that criminal proceedings are more sensitive than civil arguments but I will post the final decisions regarding my complaints so if the police reject my allegations and the evidence I have provided I will say so. If any of these matters actually get a hearing in a criminal court I will post a full transcript whether I win or lose and I will proceed with my civil complaints regardless of the outcome of any criminal proceedings.

They are really beginning to make me ill now... today the workment turned up to repair the walls and ceilings we had no notice that they were coming today. I went to sleep at 05.00 last night because I was so ill and had to get up at 08.00 to let them in. They need the rooms recleared and the loft. The day before it was the electrician. I`m glad they are finally getting the work done but refusing to let us know when people arrive is just like a baby having a tantrum even though its effects are equal to psychological assault. My children and my wife are all ill so samples are being taken from the leakage coming through the walls because it needs bacteriological tests.

First half was a real day from hell thanks to Amicus Horizon. 08.00 this morning the workmen turned up to fix the walls, they were surprised that I knew nothing about it.
Booker and Best accepted that they had not told me that they would be coming so after nine days of diazepam and tramadol and very little sleep and general tiredness of what seems like spiteful behaviour from Amicus Horizon I started ringing round. Ron Grimmer insisted that he had generated a letter to me dated the 11th February 2010 to let me know that the work was going to be done. I was sure that this was not true because the work was,nt even requested until the 16th. but when I checked our records I had received a letter stating that the electrician would be coming to inspect on the 02nd,March and I assume that was the letter that Ron Grimmer thought mentioned the other works. Fortunately and unusually the day ended much better than it had begun the electrician who has been working here since yesterday did a lot of work and apart from making it look better we now at last have working smoke alarms which is something that has caused more stress and worry than you would imagine over the past 7-8 months and the two workmen who came to do the walls did`nt go nuts because the place was`nt ready for them they were very cool and understanding and agreed to do one or two rooms at a time.
Once again it was the complete lack of any competence or organisation that made things a living nightmare so once I recognised that I asked if Amicus Horizon would step out of it and allow Booker and Best to make arrangements and the house is already showing signs of real improvement.
I have legitimate gripes with Booker and Best the door they installed was dangerously pathetic and I don`t think even they would dispute that but they did offer to sort that out straight away, it was Amicus Horizon who denied permission for 8 months. The damage from the leaks I think would also have been minimal if Amicus Horizon had put through the works orders. The only real problem that I have with Booker and Best that I really feel cheated about is the falsified date on the work receipt for the burst pipe repair which is dated about 7 days before the work actually took place, anmd the gas disconnection those sort of errors are not forgiveable and may not even be legal but the sad fact is that you cannot apply the same logic to Amicus Horizon they are a complete mess and they don`t apologise and try to put things right their methods never vary they call you a liar and then stop all communication. Today Ron Grimmer denied that I had ever sent him any correspondence. Darren Goodsell the same. John Head like the others just refuses to reply and that applys all the way from the very top Steve Walker.
Ron Grimmer even denied that Hastings council had sent him a notice regarding the hazards in this house yet the workmen are here doing the work.
I must somehow get through the next few weeks or however long it takes for the repairs to be done but it will be nice to have a safe home again after they have finished.
Do you know the answer to this question?
Over the past couple of weeks we have had quite a few emails from tenants who have no smoke alarms at all even flat occupants, is there a housing law that says social housing tenants must have a smoke alarm?

Okay maybe I spoke a little too soon. But there is no law denying anyone the right to hope for the best. The front walls are mended and plastered up now but still no one including us seems to know what is happening. We know that Booker and Best are returning on the 24th to do the rear wall but in the meantime we are just tantalisingly close to our children having a bedroom and the only people who can provide any further progress are Amicus Horizon. I have a direct accusation for Amicus Horizon and Hastings Borough Council to consider. I offered it to the council, the police and Amicus Horizon but no one seems to mind if Amicu Horizon fiddle the books. The legal advice I have had so far is that the claimant (You/Me) are responsible but I think that it is Hastings council who are responsible after all they set the rents and the council tax and Amicus Horizon must know if they are entitled to charge for something they are not supplying?
It is a fact proven by records kept by East Sussex County Council and Hastings Borough Council and by records that must by law be kept by Amicus Horizon Housing Corporation and the Department of Works and Pensions and by Quarterly and annual statements in my possession that between the months of November 2005 and March 2010 and continuing that our landlord Amicus Horizon has benefited from the payments of differing amounts of benefit payments paid for on behalf of the tenant of the property referred to in the allegations and that it is not plausible that Amicus Horizon did not have the expertise to automatically realise that they were overcharging the claimant for property/services for which they were charging the rent. It is a part of my allegation that Amicus Horizon must have been fully aware that they were collecting money on behalf of the claimant for property that they knew he could not inhabit or use, or use safely because of defects/health hazards and/or dangerous installations. They have been aware at all times since the tenancy began and the rent charge was applied that they were demanding money for property/services to which they were not entitled and that by their actions they were committing an act of fraud or causing the claimant to commit or abet them in committing an act of fraud or gaining a pecuniary advantage and that during the entire period they made no attempts to apply any of that income to bringing the property/services that they were charging up to a standard that would justify the charge.
No attempt has been made by Amicus Horizon to refund any of the monies demanded and received for any of the above to the benefit claimant or the government agencies contributions to them on behalf of the benefit claimant and that the obvious knowledge of Amicus Horizon that they were not entitled to the amount that they were demanding over such a long period of time despite numerous enquiries to them by the benefit claimant regarding benefit fraud it is my allegation that they have committed an act of deception and/or pecuniary advantage against the benefit claimant and those agencies contributing to those payments on his behalf.
It is also my allegation that Hastings Borough Council had a civic duty to set the rent of the property referred to in the allegations on behalf of the tenant and the agencies responsible for contributing to those rent charges and that Hastings council has by their actions/failures/refusals aided and abetted Amicus Horizon to benefit from public funding that they had no proper legal right to demand or keep.
It is also a part of my allegation(s) against Amicus Horizon (who control over 28,000 properties) and Hastings Borough Council that it is extremely unlikely that this is an isolated or unique occurrence and that Hastings Council who vigorously investigate private individuals/tenants for benefit fraud have by their failures/assumptions allowed Amicus Horizon immunity from investigation procedures/checks, prosecutions or other penalties that Hastings Council would automatically apply to any other individual or private company who they suspected might be profiting from overpayment of benefit payments.

I have just received a reply from Mr John Head in regard to the above question. As Mr Head and Amicus Horizon are fully aware this questions relates directly to a visit by John Head where 90% of his replies were No Comment but amongst those no comments there was a firm commitment to carry out painting works on the 03rd March 2010. and an introduction to the painter who would be carrying out the work who Mr Head showed round our house to confirm that he knew exactly what it was that he would need to do, and on which date he would be doing it. According to Mr John Head none of this happened. He says that a copy of his letter dated the 19th February 2010 is enclosed... Nothing is enclosed at all... I have now spoken to Mr Head on the phone 13.39p.m and although I dispute his account of his visit I am content that once again most of the doubts in regard to that visit and since are caused by the total lack of communication between the different departments of Amicus Horizon and Amicus Horizon and their tenants Mr Head confirmed to me that no person of bad character is used on work in tenants home which I found very helpful and reassuring (not meant sarcastically)

I was shocked at the video which I was able to veiw at the verbal attacks you are enduring and they are obviously behaviour that should cause concern. I have at last received a reply from the Equality and Human Rights Commission who have advised me on where I am right and where others are wrong. They have advised me also on Obligations of Public bodies under the Human Rights Act and I have asked Liberty to assist me in regard to these matters.
They have sent me quite a long reply too long to post here and pointless really as Hastings Council, East Sussex County Council and Amicus Horizon probaby are all familiar with their obligations to Disability discrimination laws. Their first recommendation is that I contact the police which I have done again today and I have forwarded a copy of their response and the EHRC reply to my solicitors.

A bullying approach from a body supported with public funds is never a good start in my book. Worse still, even though Amicus intend to proceed with 100% affordable housing - in planning terms we are only able to request 35% - if this housing association sells the site on with the new planning permission we really are stuffed. But I should add that I don't believe there are any plans to sell the property on - but if Amicus are unable for whatever reason to get the grants they need then that of course will be an option. In planning terms unless it's in writing, guaranteed by a condition or a S106 agreement it has little weight -
when push comes to shove in the building phase many fine promises made at committee can be conveniently forgotten if needed.

I really need help today I am in so much pain but I am still waiting for Hastings police to come and take my complaint I`m getting by on tramadol and diazepam but the police will not challenge or investigate Amicus Horizon any more than Hastings council will. I will video every meeting but unless I can get some support from sites like this my situation will get worse rather than better. I can barely move today I have spent the last 5 years fighting Amicus for myself or other residents if you would like to help me leave a comment and ask sussex police why they do not consider disability discrimination a crime... If I was a victim of a racial attack they would act so fast yet disability discrimination is far more devastating.

Hi I know this family and the conditions they have to live with are appalling and Graeme is always in a lot of pain, I have seen the repairs they have done in the past if they were mine I would have taken them to court for damages and would have won a lot of money the condition of the house makes life very difficult and they should be ashamed of themselves (amicus Horizon) I mean,this is worse than a racial attack they soon get help just say racial and everyone bends over backwards shame on you disability should come first.

Hi, thanks for your support. the police are not ignorant of the law they are like our other local services council etc under the control of Amicus Horizon and this is not restricted to me or Hastings yesterday councillor Dean (Deansblog) described how unhealthy it was for his council to be under the control of a bullying Amicus Horizon (his words not mine) If a Amicus Horizon housing manager points a finger at a resident and whispers undesireable family/bad child/unhealthy website to your local community police officer then you have a serious problem and you are over time put into the position where you are complaining about everyone to everyone because once your local authorities surrender their powers to an organisation that bends or ignores the law rather than respects and supports it then the vulnerable tenant is put at risk. In fact all tenants are put at risk. Hastings council-Amicus Horizon you have these choices... Hit Squad.. Jail... Still sleeping in chairs because we do not have a bedroom. Hastings council... What are you doing allowing this modern day rogue landlord to behave like this? by allowing Amicus Horizon to break the law you are breaking the law and so is every other public body in this area who`s public function is to protect social tenants from this sort of treatment and I believe that includes the Hastings Police who are so dragging their feet it is beginning to look odd!

Hastings police took my complaint against Amicus Horizon today. Sooner or later someone at Amicus Horizon is going to realise that they are breaking the law on a daily basis and advise them to change the way they do things, or don`t do things.

Booker and Best came out this morning as arranged and fixed our electric sockets, not earth shattering news I know but by doing this it goes a little way to proving our point about Amicus Horizon because I deliberately did not report this fault to them I reported it directly to Booker and Best. If I had reported it to Amicus Horizon then if you have been following any of these postings you`ll know that the repair would not be done for months. It makes no difference what I want or don`t want the importance of this site is it`s complete accuracy and detail because that is what will get them in the end. I have great faith in the law and it`s fairness but nothing is perfect and where I think it can sometimes be a bit unjust is in cases like this because when I finally get Amicus Horizon into court for these things they will probably automatically make Booker and Best a third party because they are the contractors but in all fairness to Booker and Best 90% of our problems have been caused by Amicus Horizons mismanagement and their policies and belief that their power allows them some kind of immunity, it does`nt it just allows them to delay. The fact is that Amicus Horizon did a lot of harm when they moved their fault repair line from Booker and Best to what sounds like someones kitchen in Sittingbourne and if these repair problems had been left with Booker and Best then they would have probably been sorted out without most of this painful process.

I received a letter today from John Head, the same adaptation expert who states very clearly on a recorded meeting that disabled tenants have no rights to adaptations if they are registered on a home exchange site. His exact words were "Make up your mind do you want to move or have adaptations" I asked Hastings council about this remark and they said it was complete nonsense if you have a disability and need an adaptation then you should get it.
John Head says that he has now at my request???... put the planned redecoration/ceiling repairs on hold. So once again the bedrooms are uninhabitable for another unspecified period of time.
My comments to Mr Head were what is the point in painting walls/ceilings a few days before you come in and take the plaster off, it will all just need repainting to which he replied "I don`t care"
What is needed is for the repairs to be done to the walls that were first promised in November 2005. The repairs to the ceilings which were first booked in May 2009 and then the redecoration, bear in mind that all of this is redecoration needed because of damage caused by Amicus Horizon not me. I think it is so sad that so many keen and intelligent young people cannot get a job while so many "smart" people with obsolete attitudes are entrusted with responsibilities that they think are weapons for their personal use against the most vulnerable of the tenants they are paid and trained? to support, it`s a bit like going to the doctor and pleading help me, help me, I`ve only got 58 seconds to live and have the doctor say take a seat I`ll be with you in a minute. I`ll pass the letter on to the solicitors etc and wait for my day in court which I will get.
