Without Prejudice.
Dear Mr Goodsell,
In one last attempt to have my complaints resolved fairly I would like you to consider the following ndisputable facts.
On three seperate occasions during your visit with Booker and Best you agree that the door is dangerous.
On one occasion you agree that the door is a danger to my "not disabled" children Booker and Best agree the same.
On one occasion you agree that the order for a fire door was cancelled by Amicus Horizon not by Booker and Best and you state that you are not happy and that and you want a fire door installed. You also state that it is your opinion that you would like to see a split door fitted and you state that that is what you will arrange to be installed as soon as possible.
Booker and Best state that the leak was present for a considerable time and a large amount of water had collected under the floor. You agree with that report.
Booker and Best state that the pipework is very old and that the water probably just followed the path of the pipework above our bedroom area,
Booker and Best confirm that turning off the water would not have stopped the water
You agree and Booker and Best agrees and confirms that it is your opinions and that of the first plumber that the leak caused a large amount of water to collect under the floor.
You agree that Amicus Horizon instructed me to make holes in the ceilings to drain off the water.
Booker and Best advise that this was the wrong thing to do.
You accept that the property was not made safe.
You state that Amicus Horizons policy of compensation is not designed to compensate tenants who suffer unexpected damage or damage to personal property.
You accept a list of 10 problems and you agree to deal with every item.
Booker and Best state that they have never had a problem with me as a customer.
Both you and Booker and Best agree that you would not accept this installation in your own homes.
You state that if Amicus Horizon make mistakes you would be the first to say sorry. You then apologise for the past and state that you will arrange for my housing manager to visit and discuss all past issues.
You state that clearly things have gone wrong and that you are going to sort things out.
You state that although you do not personally believe that I will get the compensation that you think I deserve because it is not your companies policy.
You state that you think these matters should be dealt with urgently.
I believe the above shows that Amicus Horizon are more responsible than Booker and Best and that Amicus Horizon have dealt with these matters wrongly. I believe it also shows that Amicus Horizon are not only responsible for the failure to make my property safe but also the damage that was caused by that failure including the ceiling repairs and the necessary redecorations to the rooms affected.
I have still not heard from my housing manager regarding the other issues despite your promises that I would.
If my solicitor has no objections I will publish all of the above in order to show the other tenants following these issues that I have been telling the truth and to show them that they need to exercise care when dealing with your company.
Despite your personal assurances regarding your companies refusal to respond to these and any other future issues properly or at all, you have failed to respond on several occasions, in fact on all occasions since this matter escalated to a legal dispute.

Dear Mr Morgan I acknowledge receipt of all your recent emails. I would like to make clear my views on the door issue. At the visit with Andy Miller and myself, you stated you were advised that we are obliged by law to provide a fire door. At that time, I was unable to dispute this and only agreed that if one was legally required, then we should provide one for health and safety reasons as well as complying with any legal requirements. I have since been advised that this is not the case. We are not required to install a fire door. If you still dispute this, I suggest you provide evidence as such or ask your solicitor to do the same and we will respond accordingly. Having reviewed the situation with Booker & Best, Geoff Dixon from Booker & Best will be writing to you to advise of the options to install an alternative door to your kitchen. Booker & Best remain the contractor I intend to use to carry out this repair as advised in my previous email. If you do not allow access to Booker & Best for this work, we will be unable install the door. Regarding the compensation claim decision and your statements below. As stated in my letter, taking into account the advice from Booker & Best and relevant facts presented to me, in my opinion there was insufficient evidence for me to conclude compensation was due for alleged damage to your television and DVD player from the leak. If you disagree with my decision, you may appeal requesting that it is reviewed as a new complaint. Please advise if you wish to do so. I will be speaking to the housing teams in the next few days to ask them to arrange a response to your queries. Finally, if you remain dissatisfied with my original response to your complaint, please advise if you would like it to be progressed to Stage 2 of our complaints procedure.
